These Terms and Conditions (“Terms”) govern the use of the Lowkii Productions website, all studio bookings, and the provision of photography and videography services (“Services”) by Lowkii Productions (“we”, “us”, or “the Studio”). By booking a session or using our Services, you (“the Client”) agree to be bound by these Terms in full.
1.1 All studio sessions must be booked in advance through our website or by contacting us directly.
1.2 A non-refundable deposit of 50% of the total session fee is required to secure your booking. Your session is only confirmed once the deposit has been successfully processed.
1.3 The remaining balance (50%) is due on the day of the session, prior to or upon arrival at the studio.
1.4 Deposits are processed securely through Paystack. By making a payment, you also agree to Paystack's terms of service.
You may reschedule your session free of charge, subject to availability. Your deposit will be transferred to the new date. Cancellations will forfeit the deposit.
Cancellations or rescheduling within 48 hours of the booked session will result in forfeiture of the full deposit. No refunds will be issued.
Failure to attend your booked session without prior notice will result in forfeiture of the full deposit. No refund or rescheduling will be offered.
3.1 Clients must arrive at least 10 minutes before their booked session time. Late arrivals may result in reduced session time; the session will still end at the originally booked time.
3.2 The studio must be left in the condition it was found. Any damage to studio property, equipment, or backdrops will be the responsibility of the Client and may incur additional charges.
3.3 Smoking, alcohol, and illegal substances are strictly prohibited on the studio premises.
3.4 Children under 16 must be accompanied by a parent or legal guardian at all times during the session.
3.5 Lowkii Productions reserves the right to refuse service or terminate a session if the Client's behaviour is disruptive, abusive, or poses a risk to safety.
4.1 Studio space rentals provide access to the studio space and basic lighting equipment only, at a rate of R500 per hour.
4.2 Clients booking studio space rental are responsible for their own crew, equipment, and creative direction.
4.3 Any additional equipment or services required must be arranged in advance and may incur additional fees.
5.1 Copyright. All photographs and video footage produced by Lowkii Productions remain the intellectual property of Lowkii Productions unless otherwise agreed in writing.
5.2 Client Licence. Upon full payment, the Client is granted a non-exclusive, personal-use licence to the delivered images and videos. This includes use on personal social media, prints for personal display, and personal digital use.
5.3 Commercial Use. Any commercial use of images or video (advertising, merchandise, paid promotions, resale) requires a separate written commercial licence agreement and may incur additional fees.
5.4 Portfolio Usage. Lowkii Productions reserves the right to use any images or video from sessions for portfolio, marketing, social media, and promotional purposes unless the Client requests in writing prior to the session that specific images not be used publicly.
5.5 Editing. The Client may not alter, crop, apply filters to, or otherwise edit the delivered images without written permission from Lowkii Productions. This includes the application of social media filters.
6.1 Edited images and/or video will be delivered via an online gallery or file transfer link within the turnaround time specified for your package (typically 7–14 business days).
6.2 Rush delivery may be available at an additional fee — please enquire at the time of booking.
6.3 Gallery links will remain active for a minimum of 30 days from the delivery date. Clients are responsible for downloading and backing up their files within this period. We are not liable for files not downloaded before the link expires.
7.1 Lowkii Productions will make every reasonable effort to deliver high-quality work. However, we do not guarantee specific outcomes or that the results will meet subjective expectations.
7.2 In the unlikely event of equipment failure, data loss, or other technical issues beyond our control, our total liability shall not exceed the amount paid by the Client for the affected session.
7.3 Lowkii Productions is not responsible for any loss, injury, or damage to personal property while on the studio premises, except where caused by our negligence.
Lowkii Productions shall not be held liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, load shedding, power outages, civil unrest, pandemics, or government-mandated restrictions. In such cases, we will make reasonable efforts to reschedule the session at no additional cost to the Client.
9.1 Deposits are non-refundable except where the cancellation is initiated by Lowkii Productions.
9.2 If Lowkii Productions cancels a session for any reason, the Client will receive a full refund of any payments made, or the option to reschedule at no additional cost.
9.3 Refunds, where applicable, will be processed within 7–10 business days via the original payment method.
The Client agrees to indemnify and hold harmless Lowkii Productions, its owners, employees, and contractors from any claims, damages, losses, or expenses arising from the Client's breach of these Terms, misuse of delivered content, or any unlawful activity during a session.
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or the use of our Services shall be subject to the exclusive jurisdiction of the courts of KwaZulu-Natal, South Africa.
Lowkii Productions reserves the right to amend these Terms at any time. Updated Terms will be posted on this page with a revised date. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
